1. The property is known as ‘Serengeti Villa’ and is situated at Four Corners, Davenport, hereinafter-called “the property” and is offered for holiday rental subject to confirmation by Stuart Bukraba and Susan Bukraba, hereinafter called “the owners”. The person who signs the booking form on behalf of all his/her party is hereinafter called “the client”
2. To reserve the property, the client should complete and sign the booking form and the terms and conditions and return them together with a £150/$240 per week deposit. On receipt of the deposit and return of the booking form and terms and conditions, the owner will send or e-mail the confirmation letter and receipt and this is the formal acceptance of the booking.
3. Your holiday home rental includes accommodation as booked, including services, eg water and electricity (excludes pool heating unless otherwise stated).
4. If you are forced to cancel your holiday within 10 weeks of your departure date, the owner shall be entitled to retain all payments already made (except the security deposit) and to recover, if not already paid the balance of the hiring charge. If you cancel more than 10 weeks before your departure date, any deposit paid will be forfeited whether you are insured for this risk or not.
5. Final payment (the remaining balance) must be made no later than 10 weeks prior to the arrival date as stated on the booking form. If the final payment is not received by this date, the owner has the right to re-let the property without refunding the deposit and the client will lose the reservation.
6. A security deposit of £150/$240 will be payable with the remaining balance and will be refunded in whole or in part (normally within 14 days of your return home) after the property has been checked. Any breakages, loss or damages will be deducted from the security deposit. The client is solely responsible for any damage or breakages that may be caused to the property and/or to its contents and also for any loss of any items in the inventory during their stay. Upon arrival the client should immediately report any damage to the premises to the management company.
The property is fitted with an electronic keypad entry, with a backup key held in the lockbox. The client is responsible for the safe return of the key (if used) to the lock box on the property and if the key is not returned or is lost, the cost of changing the lock will be deducted from the security deposit. The villa is protected by an ADT monitored security system, which not only acts as a burglar deterrent but is also a monitored fire alarm. Therefore it is a condition of booking Serengeti Villa that all guests activate the alarm whenever the villa is left unattended
A Sony Playstation 2. Nintendo Gamecube and a Nintendo Wii Console have been provided free of charge for use by the client. These systems include the main unit, 2 controls each, several games and a memory card for the PS2 and Gamecube. The client is responsible for the proper use of the systems and their various components and if, when the inventory is completed upon the clients’ departure, it is noted that any games or any other components of the systems are missing, the cost to replace the missing items will be deducted from the security deposit.
Charges for damages, losses or any maintenance or repairs to the premises, equipment or amenities or fixtures or any cleaning services over and above those normally required to prepare the property for the next guest, which are necessitated by misuse or extraordinary uncleanliness will be at the discretion of the management company and will be deducted from the security deposit.
Strictly no pets are allowed in the villa at any time.
The property is designated as a “no smoking” property and all clients are asked to refrain from smoking inside the house. In the event that this is not adhered to and it is necessary that a neutralisation of smoke odours is required, or in the event that burn marks from cigarettes, pipes or other smoking materials are detected, the cost for elimination of those odours or repairs to the burn marks will be deducted from the security deposit.
Should the security deposit be insufficient to meet such costs or liability any additional amounts are payable by the client within 14 days of written notification of such by the owners. The sum reserved in this clause shall not limit the clients’ liability to the owners.
7. The client is strongly recommended to arrange for a comprehensive travel insurance policy and to have full cover for the parties personal belongings, public liability, booking cancellation etc, as these are not covered by the owners insurance.
8. The rental period shall commence at 4.00 pm on the first day and finish at 10.00 am on the last day of the period defined in the booking form. The owner shall not be obliged to offer the accommodation before this time and the client shall not be entitled to remain in occupation after the time stated.
9. The maximum number to reside in the property must not exceed the number of persons declared on the booking form. The client agrees not to sublet or share the property except with persons nominated on the booking form. Please note that contravention of the above will render your booking void, all monies paid will be forfeited and you will be asked to leave the villa immediately without further compensation.
10. The client agrees to be a considerate tenant and to take good care of the property and to leave it in a clean and tidy condition at the end of the stated period. The client also agrees not to act in any way which would cause disturbance to those resident in the neighbouring properties.
11. In the unlikely event that you should have a problem with the property or its facilities, please bring this to the attention of the management company immediately so that they can investigate and attempt to resolve the issue locally. If you do not bring your complaint to the management company’s attention immediately, you will not have allowed them the opportunity to satisfactorily solve your problem.
12. Although every effort has been made to ensure that the property is in superior condition, neither the owners, the management company nor their agents shall be held responsible for any third party claims, accidents, damage to or loss of property or for any expenses incurred for any reason including changes caused by force majeure, adverse weather conditions, riot, war, strikes or other matters beyond the control of the owner regardless of how they may have occurred, nor can liability be accepted by the owners, the management company or their agents for injury to anyone as a result of the use of the pool however so caused. Upon arrival at the property the client should note the pool rules and regulations that have been posted, a copy of which is available upon request. Clients are specifically advised not to allow unsupervised children into the pool area. Rendering the pool door alarms inoperable on the patio doors leading from the property to the patio/pool area is illegal (this is a federal offence in Florida) and is strictly forbidden.
13. Florida has a tropical climate which is ideal for both humans and unfortunately pests. These are not an unusual occurrence and for this reason, the property has a monthly pest control program. To help eliminate these uninvited guests, we recommend that all windows and doors remain shut at all times and that all opened food is stored in the refrigerator provided. If you become aware of a pest problem inside the home, sprays such as Raid, can be purchased locally. If the problem is more widespread you must inform the management company immediately so that the appropriate treatment can be initiated.
14. HD Cable Box - A HD cable box is provided for guests use. The owners will use their best endeavours to ensure that the service is available for use, but cannot be held responsible for any failures, or non-availability, of communication lines, hardware or software. Please note that this service with a comprehensive channel line up including some HD channels is provided FREE to guests – However if the guest should order any pay-per-view or premium channels (which are not provided by the owners) during their stay, any additional costs billed by the cable company will be deducted from the guests security deposit . The signing of our terms and conditions forms a contract between your party and us (the owners) and within the terms of this contract you agree to pay for any pay per view/premium channels ordered in the home.
15. Computer & Internet - A computer and DSL Internet connection is provided for guests use. Please note that this service is provided FREE to guests. The owners will use their best endeavours to ensure that the service is available for use, but cannot be held responsible for any failures, or non-availability, of communication lines, hardware or software. Signing of our booking form is a contract between your party and us and within the terms of this contract you agree not to download or save any pornographic, offensive, obscene or illegal material, and abide by the user instructions in the home.
16. Swimming Pool – The pool depth is from approx. 3 feet to approx. 5 feet and the jacuzzi is approx. 3ft 6inches deep. The pool is regularly inspected, cleaned and maintained but may be affected by dust, dirt or insects, particularly during or after bad weather. BREAKDOWN – Very occasionally, pool heating breaks down – in the unlikely event that the pool heating breaks down during your stay (if you have pre-ordered this), the client will refund the unused portion of pool heating costs. POOL HEATING – This is recommended (but not compulsory!) for stays between October and April (but can be ordered for any month, at your choice) and must be requested on the Booking Form – there is a 7 day minimum period for pool heating. You should note that our jacuzzi cannot be heated separately from the pool as it has a waterfall feature which runs water in the pool – if you wish to have the jacuzzi heated, you will need to order pool heating. WEATHER – The owners are unable to guarantee the water temperature with pool heating as this will depend on the prevailing weather conditions. If you have ordered pool heating but the weather is warm, you will pay for ordered pool heating as this will have been turned on in advance of your arrival and no refunds will be given in these circumstances. WARMING UP – Pool heating will be turned on (at some time between 10.00 am up to 4.00 pm check-in time) on your check-in day, prior to your arrival. Depending on the weather conditions the water can take some hours to reach optimum temperature. Please note that the management company or the owner accept no liability for compensation for the loss of pool heating or lighting facilities other than as noted above. POOL COVER – a pool cover has been provided for use during the cooler months – the cover is on a roller for ease of use and should be used to cover the pool each evening. This will help retain some of the pool heat that would normally be lost overnight when temperatures drop. This will ensure warmer pool temperatures for early morning swims.
17. In the unlikely event that circumstances beyond our control necessitate the cancellation of the holiday arrangements, the owners reserve the right to cancel the booking at any time and will only be liable to refund monies paid by the client without interest or compensation.
18. No liability is accepted by the owner for loss of main services or failure of appliances, nor for the consequences of the actions or omissions of persons who may control supply of mains service, nor any actions taken in the vicinity of the property by any authority over which there is no control by the Owner. Furthermore, it is possible that some construction work may take place in the area of new homes. The client should establish the status of the development prior to booking.
19. This contract shall be interpreted and governed according to English Law.
